Um casal procurou o Judiciário pedindo danos morais contra uma fundação de saúde que atende o Município de Pontes e Lacerda. Eles buscavam a indenização pela morte de seu filho durante o nascimento. O caso chegou à 2ª Câmara de Direito Público e Coletivo do Tribunal de Justiça de Mato Grosso (TJMT) que, por unanimidade, considerou que mãe da criança deve ser indenizada em R$ 30 mil e o pai em R$ 15 mil pelos danos morais sofridos. O relator foi o desembargador Luiz Carlos da Costa e seu voto foi seguido pela desembargadora Maria Aparecida Fago e pelo desembargador Mario Kono.
A mãe procurou o hospital por ter sido orientada durante o pré-natal de que estaria quase com 41 semanas e que poderia procurar um hospital logo que percebesse sinais do parto. Ao começar a sentir dores no pé da barriga ela foi à unidade, passou pelo exame do toque e foi verificado que os batimentos do coração do filho estavam normais.
A enfermeira, segundo a mãe, informou que e o colo do útero estava fechado, e que a dor que ela estava sentindo era dor “acomodativa” A gestante questionou se ainda poderia ter parto normal e a profissional garantiu que sim, mas que não precisaria de internação naquele momento devendo retornar em torno de 6 dias, quando completaria a 41º semana de gestação.
Mas ela acabou ficando com sintomas de gripe, como tosse, e as dores se intensificaram o que a levou a retornar no hospital. Durante o atendimento, o médico não teria examinado se os batimentos da criança estariam normais e apenas teria recomendado à mulher que “nesse caso era para tomar liquido, e chupar gelo, e mandou ela embora”.
No dia seguinte, sob fortes dores a mãe retornou ao hospital e, ao ser verificado que os batimentos cardíacos do bebê estavam fracos, ela foi levada ao centro cirúrgico para uma cesárea de emergência. Em seu relato, a mulher detalha que, durante o parto, um dos médicos tentava tirar o neném, mas não conseguia. Foi quando o segundo médico empurrou o neném de cima para baixo, por três vezes.
A mãe conta que o filho nasceu após os empurrões e puxões e ela não ouviu nenhum choro e, ao virar o seu rosto viu um dos profissionais fazendo massagem no peito e foi levado a outra sala. O médico que ainda estava na sala fez a sutura e foi embora, ficando ela com as enfermeiras. Após a cirurgia a mulher continuou tendo sangramento e foi encaminhada para Cáceres, onde passou por nova cirurgia.
“Dos fatos narrados e dos documentos apresentados constata-se que houve falha no atendimento, uma vez que ao retornar no dia 21 de junho de 2019, ainda que a genitora alegasse sintomas gripais, não foi realizado ultrassom ou escuta do coração do bebê, com a finalidade de verificar a sua condição. Ademais, durante o parto cesárea a genitora relata que para retirada de seu filho foram realizados empurrões e puxões e quando obtido êxito seu filho já estava morto”, considerou o desembargador em voto.
Decisão por danos morais – O casal ingressou com ação na Justiça pedindo danos morais e o caso chegou ao Tribunal de Justiça que reconheceu tanto o direito da mãe quanto do pai em receber.
O relator pontuou que o pai perdeu seu filho não por um infortúnio, mas em decorrência da imperícia da equipe médica do hospital que realizou tardiamente o parto cesárea.
“De fato, há nexo de causalidade entre a conduta médica e, o falecimento do filho dos apelantes, uma vez que a causa da morte decorreria de insuficiência placentária. No entanto, as providências adotadas não foram capazes de evitar o desfecho fatal, já que o filho dos apelantes acabou por nascer morto”, afirma.
O Município de Pontes e Lacerda se manifestou afirmando não possuir contrato com a Fundação. Porém, consta no documento nominado de “Ficha de Estabelecimento Identificação” a vinculação. “Daí decorrente, a responsabilidade civil do Município é solidária, uma vez que se trata de Hospital conveniado com o Sistema Único de Saúde (SUS)”, concluiu o relator.
