A Justiça de Mato Grosso determinou o encerramento da recuperação judicial da Prol Indústria Metalúrgica. A decisão foi proferida pela juíza da 4ª Vara Cível de Várzea Grande, Sílvia Renata Anffe Souza. A empresa, especializada na produção de móveis de aço, completa em 2024 40 anos de fundação. Ao pedir a recuperação judicial, a indústria apresentou dívidas de R$ 11,6 milhões.
O pedido para o encerramento da recuperação judicial foi apresentado pelo advogado Marco Aurélio Mestre Medeiros. Ele destacou que a empresa cumpriu rigorosamente o Plano de Recuperação Judicial aprovado pela assembleia de credores e homologado pelo Poder Judiciário. Consultado, o Ministério Público Estadual (MPE) deu parecer favorável ao pedido.
Ao acolher a solicitação, a magistrada destacou que a Prol conseguiu superar a crise econômica que motivou o pedido de recuperação judicial, cumprindo desta forma o que é almejado com a legislação que trata do assunto. A afirmação se baseia no relatório da Administradora Judicial, que fiscalizou todo o processo. “A recuperanda cumpriu com o que apresentou em seu plano de recuperação judicial, satisfazendo com o que foi aprovado e homologado”.
Na avaliação de Medeiros, o encerramento do processo de recuperação judicial da Prol, determinado após a confirmação de que a indústria cumpriu o plano, reafirma que a legislação atual tem sido eficaz em preservar as empresas e, desta forma, os empregos diretos e indiretos que elas geram. “Isso assegura a continuidade da função socioeconômica que estas empresas possuem em suas comunidades e, de forma ampliada, no estado como um todo”.
Além disso, Sílvia pontuou que, durante o período de recuperação judicial, a empresa demonstrou solidez e capacidade financeira, demonstrada pela tradição de longos anos no mercado, pela contribuição para o desenvolvimento da região e pela geração de empregos no município.
A Prol ingressou com o pedido de recuperação judicial em 2018. Na solicitação, a empresa explicou que os problemas que motivaram a abertura do processo se deram por conta da crise econômica iniciada após a Copa do Mundo de 2014.
